As employees begin to return to work and government restrictions reduce, there has been speculation around weather or not employers have the right to request this data.
Information regarding anyone’s vaccination is categorised under GDPR as specific personal data which is part of their personal health record which is why employers have been unsure.
The Data Protection Commission (DPC) has cleared this up now and there is no legal basis for employers to request this information, with the exception of Healthcare workers where the vaccine has been considered a necessary safety measure.
The vaccination has been rolled out and people have been voluntarily opting into having it, which means that it’s non compulsory and the individuals decision to have it, meaning the vaccine shouldn’t be considered as a compulsory workplace measure.
These Guidelines are subject to review if the public health advice and laws change. Employers should closely follow changes in public health guidance and laws.
